To: State Agency, Colleges, Universities, Boards and Commissions

Subject: Equipment purchased with grant funds
For State property deemed surplus for whatever reason by an agency, college, university board or commission per NCGS 143-64-.03 (a), the State Surplus Property Agency is authorized and directed to sell all supplies, materials, and equipment that are surplus, obsolete or unused. It is understood that state property is any property; purchased with state funds; donated to the state; or purchased with other funds that give ownership of the property to the state.
In most cases, the terms of a grant determine ownership of the equipment and/or provides instructions for equipment when the grant ends. Others remain silent on this issue. For grants that do not designate a disposition of materials and equipment purchased with the grant funds that property is deemed state property.
If grant funded research moves to another university, public or private, please contact State Surplus Property for instruction on transferring the property.
If property is determined to be state owned and it is deemed surplus, the final disposition of such property must be authorized by the NC State Surplus Property Agency.
