Hazardous Materials

TO: Persons Responsible for Surplus Property Disposal

FROM: Gwen Williams, Director, Division of Surplus Property

YOU are the last line of defense to protect your agency and the public from exposure to Hazardous Materials. Per NC Administrative Code 01 NCAC 43A.0202, and General Statutes 143-64.01 and 143-64.04, equipment or containers that contain compressed gases, flammable, nuclear, chemical, biological, radioactive or other hazardous materials or any container or equipment that contained any of these materials is not accepted at the State Surplus Property Agency unless:

  1. Each agency must contact its safety office and ensure compliance with all federal, state, and local law & regulations, and keeps record of proper disposal documentation prior to the transport, sale, or disposal of items described. A copy of this documentation must be sent with the item for Surplus Records.
  2. The equipment or containers are rendered and declared safe by the owning agency, and a statement to this effect included in the item description when a disposal or sale of the item is requested. A copy of this documentation must be sent with the item for Surplus Records.
  3. At the time the container or equipment is rendered safe and certified, the labeling that indicates the container or equipment was contaminated (or contained any hazardous materials) must be removed.

Laboratory Equipment with non-regulated amounts of hazardous materials may be sold at the owning agency location. DO NOT TRANSPORT these items to the State Surplus Property Agency. To conduct a sale of these items, contact Lisa Henderson at 919-817-5600. Lab equipment rendered safe follows the steps above.
